COURT-APPROVED LEGAL NOTICE FROM CITIZENSHIP AND IMMIGRATION CANADA
NOTICE OF PROPOSED SETTLEMENT OF A CLASS ACTION LAWSUIT IN CANADA, RELTINGD TO CERTAIN ECONOMIC CLASS APPLIMANTS SEEKING IMMIGRANT VISAS:
1. WHY YOU RECEIVED THIS NOTICE:
You have received this Notice because you may be a member of the following group or “class ” of persons, who have submitted applications in 2001 or EARLIER seeking immigrant visas in the economic class, to the Department of Citizenship and Immigration.
Class Definition:
The class of visa applicants affected by this Notice consists of:
a. persons who submitted an application seeking an immigrant visa before January 1,2002,in the skilled worker, self-employed, entrepreneur and investor categories(referred to in subsection 8(1) of the former Immigration Regulations,1978), excluding provincial nominees and those destined to Quebec:
(ⅰ) whose applications had not received a selection decision before April 1,2003;
(ⅱ) whose applications were refused after March 31,2003 and before December 1,2003,and who have reapplied on or before December 31,2004;
(ⅲ) whose applications were withdrawn on or after January 1, 2002 and before December 1, 2003,and who have reapplied on or before December 31, 2004;
or
(ⅳ) whose applications were refused under the Immigration Act and then referred back by the Federal Court , the Federal Court of Appeal, or the Supreme Court of Canada, and were ,awaiting a decision on December 1, 2003; and
b. all family members as defined in the Immigration and Refugee Protection Regulations, of persons referred to in (a), above, including family members who were not listed in the application.
2. PURPOSE OF THIS NOTICE:
This Notice informs you of the Rasolzadeh class action lawsuit filed in Canada. You may be a named defendant in one of 149 proceedings which have been commenced on behalf of individuals who come within the Class Definition. The lawyers involved in the 149 proceeding s were Lorne Waldman,………… . All of these matters, as they relate to the Class, have effectively been consolidated into the Rasolzadeh class action for the purpose of the Settlement Agreement. ……………….
This Notice gives you information on how and when to take these steps, if you wish to do so.

3. PROPOSED SETTLEMENT OF THE RASOLZADEH CLASS ACTION:
Pursuant to the Draft Settlement Agreement, all class Members’ applications seeking immigrant visas will receive a selection decision in accordance with the following timeframes, if the Minister of Citizenship and Immigration decides in April of 2005, to proceed with the Settlement:
(a) those submitted in 1999 or earlier, by February 1, 2006;
(b) those submitted in 2000, by February 1, 2007;
(c) those submitted in 2000, by August 1, 2008.
These timeframes provided for in the Draft Settlement Agreement, constitute accelerated consideration of all Class Members’ applications seeking visas and represent the allocation by the Minister ………..a total of $2.96 million for legal fees and disbursements.
In exchange for these Settlement benefits, Class Members release and discharge all claims against the Minister of ……..to issue him a visa, so long as that challenge is on legal grounds different from and unrelated to those raised in the Rasolzadeh class action.
