UBC 中 国 学 生 学 者 联 谊 会 章 程
  ( 2005 年 4 月 1 日 全体会员大会表决通过)  


UBC 中国学生学者联谊会(简称联谊会,英文缩写UBC CSSA)主要是由来自中华人民共和国,在 University of British Columbia (UBC ) 学习和工作的学生和学者组成的一个独立组织 。
一、 宗 旨
联谊会是一个非政治性、非牟利的独立组织。其宗旨是为会员提供协助和服务,维护会员权利。其主要工作内容 :
•  开发文化、体育等各类娱乐联谊性活动,举办有关专业知识讲座,促进会员之间的交流,增进了解,发展友谊。
•  协助会员,特别是新来的成员,克服学习、工作和生活中可能遇到的困难。
•  保持并加强与祖国的联系,以各种形式支持祖国的建设。
•  促进不同民族、不同文化以及本地友好社团的交流。
二、 会员和会费
凡在UBC学习或工作,来自中国的学生和学者,无论其是否拥有中国国籍、加拿大国籍或其他国家国籍,只要其承认本联谊会章程,均可申请成为联谊会正式会员。正式会员的 家属可申请成为家属会员,已离开UBC的前正式会员,承认联谊会章程,可成为联谊会的联络会员。正式会员、家属会员和联络会员均应缴纳会费。会费的金额由执委会决定。有效期直至其本人自愿退出本会为止 。
三、 会员的权利
联谊会正式会员有如下权利:
•  选举权和被选举权。
•  对联谊会各项事务的质询权和提议权。
•  全体正式会员总人数一半的集体,对执委会和监委会的决议有否决权,对执委会和监委会成员有罢免权。
•  正式会员、家属会员和联络会员均享有使用联谊会设备,参加联谊活动和享受会员福利的权利。
四、 会员的义务
关心和帮助联谊会的工作,遵守联谊会章程和有关规则,积极参与联谊会的活动,自觉维护联谊会的声誉。
五、 机构和职责
•  联谊会的最高权力机构是全体会员大会。 会员大会应至少每年于年末举行一次,遇有修改章程或选举执委会主席和监委会主席时则必须召开会员大会。每届执委会于任期届满时必须向会员大会提交年度工作报告和财务报告。
•  联谊会下设执委会、监委会和院系分会。
•  执委会除五名执委即主席、外联副主席、学术副主席、活动副主席、财务副主席,分别负责和主持执委会全面工作、外联和网站工作、讲座和俱乐部工作、联谊活动组织工作及财务管理工作外,还至少包括外联理事2名、学术理事2名、活动理事3名,分别配合外联副主席的、学术副主席和活动副主席独立开展工作,参与组织联谊会各项活动,参加执委会会议,并拥有表决权。 理事名额可增加,只要是有利于更多更好地开展 CSSA 工作和为下一届培养队伍。
• i. 执委会负责联谊会的日常事务,包括每年三次大型联欢会的举办。
• ii. 联谊会所有财务活动均必须经执委会讨论并半数以上通过,并由主席和财务副主席双方签字方为有效。
• iii. 执委会内部应充分发扬民主,互相配合,同心协力为会员服务。在决策过程中,应遵循少数服从多数和半数以上通过的原则。
• iv. 除一般日常事务外,执委会在遇到涉及联谊会重大事宜,如修改章程和联谊会机构建设等或意见有重大分歧时,应召开执委会和监委会联席会议或全体会员大会讨论决定。
• v. 虚心听取监委会和全体会员意见。对质询或建议,执委会一般情况下必须在一周内作出答复。
• vi. 在监委会提议或超过50名正式会员联合要求下,执委会应及时召开全体会员大会,讨论有关问题。
• vii. 联谊会的工作属自愿性质。执委会应保持廉洁,不得从中谋取私利。因工作需要而享受某种优惠或补贴必须公开。
• viii. 执委会应每半年向监委会公布一次活动经费的收支账目。在任期届满前于换届选举大会上应就本届工作情况向全体会员大会报告。
• ix. 执委会负责聘请8-10位社会各界贤达成为联谊会顾问,支持联谊会工作,扩大联谊会知名度和影响力。联谊会顾问可以是加拿大国会和BC省议会议员( 包括华裔议员 ) 等政界名人( 特别是 UBC 校友 ) 、中国领事馆领导、UBC 领导、UBC 知名教授和学者、联谊会往届领导人、加拿大或大温地区著名社团领导 ( 不仅限于华人华侨社团 ) ,著名媒体负责人和企业家等。
•  监委会设主席 1 名,监事若干名。 监委会职责是:
• i. 代表全体会员监察执委会的工作是否违背联谊会章程。及时提醒并帮助改正其工作中的偏差。
• ii. 每半年听取一次执委会工作情况和财务收支情况报告。
• iii. 向执委会反映会员的意见和建议,提供必要的咨询。
• iv. 遇有涉及联谊会重大事宜,如修改 章程和联谊会机构建设等,监委会有权要求召开执委会和监委会联席会议,监委会成员有权提供决策意见和建议,并具表决权。
• v. 如执委会拒绝听取监委会在某一原则性问题上的意见,则在超过半数监委会会员同意下,监委会主席有权要求执委会在两周内召开全体会员大会讨论有关问题。逾期监委会可以直接召集这一大会。
•  院系分会原则上可在有10位以上中国学生学者的院系成立。
• i. 院系分会设主席 1 人、理事 2 人。人选由各院系中国学生学者推举热心公众服务之人士组成,但须 CSSA 会员, 并报执委会和监委会批准和备案。
• ii. 各院系分会在遵守联谊会章程和在执委会领导下可独立开展工作和活动。
• iii. 每年可从执委会申请一定数量的经费补贴,执委会在财力允许的情况下依据各院系人数给予各分会一定补贴。
•  会员可以在联谊会的名义下,经执委会认可,成立各种俱乐部或运动队,执委会应尽量为其活动创造条件,并视具体情况给予财务支持 。
六、 选举法
•  执委会主席、副主席和监委会主席由全体会员大会通过民主选举方式产生。执委会主席和监委会主席必须由全体会员大会选举产生。执委会主席、副主席和监委会主席任期一年,欲连任者必须重新参加选举,但只能连任一次。
•  一般情况下,选举新执委会和监委会于每年12月下旬进行,并于年底前完成。当选者必须获得出席选举大会的正式会员总数一半以上赞成票。原执委会和监委会应在大会的四周前协助成立选举筹备小组,由该小组全权负责新一届执委会和监委会的选举工作。
•  原执委会和监委会成员及新一届执委会和监委会候选人均不应该参加选举筹备小组。筹备小组正式开始工作一周后,其成员即丧失退出该小组转为执委会候选人的资格。
•  选举筹备小组在新执委会和监委会产生后或新执委会主席和监委会主席产生后即自行宣布解散。
•  遇有执委会主席和/或监委会主席在全体会员大会上无候选人、职位空缺、辞职、离职,必须尽快再次召开全体会员大会选举,直至选出执委会主席和监委会主席为止;但 遇有执委会副主席在全体会员大会上无候选人、职位空缺、辞职、离职,可召开执委会和监委会联席会议公开招聘、投票选举产生,当选者必须获得出席联席会议的执委会和监 委会成员一半以上赞成票 。
•  在执委会主席、副主席和监委会主席选举产生后15日内召开执委会和监委会联席会议公开招聘执委会理事和监委会监事,任期与执委会主席、副主席和监委会主席相同。
•  原则上,未当选执委会主席、副主席和监委会主席职务的候选人,在本人自愿的前提下,自动成为执委会理事和监委会监事 。
•  原执委会在选举结束后工作交替期间应积极协助新一届执委会熟悉和开展工作,并在四周内移交联谊会的全部财产设备。凡属因故需注销或处理的,如其所有权属于领事馆,应报请领事馆比准;所有权属于联谊会的,则应经过执委会同意,进行公开拍卖。
七、 联谊会经费
•  会员的会费。
•  联谊会活动的门票收入等。
•  中国驻温哥华总领事馆的资助。
•  个人、商业界和其他团体、组织的捐赠。
八、 联谊会章程的修改
本章程经由出席全体会员大会的半数以上会员通过后即刻生效。对章程进行修改必须在同类会议上获得半数以上会员通过方为有效。

CONSTITUTION

The Chinese Student and Scholar's Association (hereinafter called CSSA) of the University of British Columbia (UBC) is composed of students and scholars originally coming from the People's Republic of China and currently pursuing academic careers at UBC.
Objects

UBC CSSA is a non-political, non-profit and independent society, whose sole mission is to provide assistance and service to its members, and to advocate and represent the interests of its members. The objects of the CSSA are:
To promote and coordinate the events and activities of recreation and entertainment within the CSSA and to hold informational and educational seminars, workshops and lectures in order to invigorate the after-school lives of its members and foster communication, mutual understanding, respect and friendship;
To provide assistance and support to its members, especially to the new comers when they encounter difficulties, hardship and vicissitude in their educational or personal lives;
To maintain and strengthen the connection and relationship between the motherland ( China ) and its members; To contribute to the prosperity of the mother country in diverse and various manners;
To promote and advocate multiculturalism; To foster and strengthen communications and friendship with local Chinese communities, other ethical groups, societies, and individuals;
Members and Fees

Anyone can apply to become the CSSA member as long as he/she is originally from China, he/she is studying, working and/or living at the UBC and recognizes the Constitution, no matter he/she has the Chinese nationality, the Canadian nationality or the nationality from any other countries of the world. There are 3 categories of the CSSA members: Voting Member, Family Member and Associate Member. The Voting Members shall be those persons who are currently registered students or scholars at UBC. The Family Member shall be the family of a voting member. The Associate Member shall be those former voting members, their families, friends or relatives, and other students and scholars who are not at UBC and recognize and observe the Constitution. All members shall pay the membership fee which is determined by the CSSA Executive Committee. The validation of the membership will last till the member is voluntarily leaving the UBC CSSA permanently.
Rights and Obligations of Members

The rights of voting members shall be:

  • To vote at any General Meeting of CSSA and be elected as members of Executive Committee or Supervisory Committee;
  • To make inquiries about any issues and subjects related to the affairs of the CSSA and to propose a resolution or motion at a General Meeting, or at any other time to the Executive Committee, or the Supervisory Committee;
  • To revoke a resolution or recall a member of the Executive Committee and the Supervisory Committee as an assembly of more than 50% of the total voting members;
  • All Voting Members, Family Members and Associate Members are entitled to the right to use any of the property of the CSSA, and to participate in all events and activities of CSSA, as well as to be entitled to discount rates to participate in all activities sponsored by CSSA.
Obligations of Members
The obligations of members shall be:

  • To be solicitous for CSSA;
  • To observe the Constitution and regulations and guidelines of CSSA;
  • To participate in events and activities organized, sponsored or sanctioned by CSSA;
  • To promote, protect and vindicate the reputation of CSSA.
Governing Board and Responsibilities


  • General Meetings have the ultimate authority and power within CSSA. At least 1 General Meeting shall be held by the end of the year, and a General Meeting has to be held in case that there is a Constitution amendment or an election of the President of the Executive Committee or the President of the Supervisory Committee. The Executive Committee shall present the annual working report and financial report to the General Meeting by the end of the term.
  • The CSSA Governing Board consists of the Executive Committee, the Supervisory Committee and the Sub-Associations in various faculties and departments at UBC.
  • The Executive Committee is composed of 5 leading executives: President, Vice-President Liaison, Vice-President Academic, Vice-President Events and Vice-President Finance who is respectively in charge of the overall CSSA work, the external affairs and website management, seminars and club management, organizing events and financial management. In addition, the Executive Committee also has at least 2   Directors Liaison, 2 Directors Academic and 3 Directors Events who are respectively working with VP Liaison, VP academic and VP Events to carry out the duties independently, to participate in organization of all the events and activities of the CSSA, to attend the CSSA Executive Committee meeting. The Directors has the same voting right as the President and the Vice-Presidents. The number of the Directors can be increased as long as it is good for carrying out the CSSA work and for nourishing the new leaders for the CSSA's future work.

    • The Executive Committee is responsible for the daily operation and routine work of the CSSA, including the regular 3 big events for celebration of the Spring Fest, the Full-Moon Fest and China 's National Day.
    • All the financial activities and expenditure of the CSSA must be discussed and approved by the half of the members of the Executive Committee, and must be signed by both the President and Vice-President Finance for being effective.
    • The Executive Committee shall work cooperatively and be unified under full democracy to provide the best service to all members. In the decision process, the principle of the majority and over-half of the members of the Committee.
    • Aside from the ordinary daily affairs, any big difference of opinions among the Executive Committee members regarding to the important issues such as amendment of the Constitution and the Governing Board shall be submitted to the Joint Meeting of the Executive Committee and the Supervisory Committee, or to the General Meeting for making decisions.
    • The Executive Committee shall take serious consideration of the suggestions and advice from the Supervisory Committee and all the members, and shall give answers to any inquiry within one week.
    • As requested by the Supervisory Committee under the resolution or by 50 voting members, the Executive Committee shall call on the General Meeting and discuss the related issues on the General Meeting.
    • The CSSA Governing Board members are working on the volunteer basis, and shall not have any corruption or make any profit for themselves under the name of the CSSA, and shall keep any received compensation open to all the members.
    • The Executive Committee shall submit the financial report semi-annually to the Supervisory Committee, and annually to the General Meeting.
    • The Executive Committee is responsible for inviting 8-10 prominent leaders from the UBC and the local society as the Advisors of the CSSA, and form an Advisory Committee in order to get the supports from these advisors for the work of the CSSA. These advisors can be the MPs, MLAs , UBC Alumni, the officials from the General Consulate of the People's Republic of China , the UBC leaders and influential scholars, past CSSA leaders, leaders from the local organizations, local media and business community.
The Supervisory Committee is composed of the President and a numbers of Supervisory Directors. Its duties are:
•  To represent all the members to supervisor the work of the Executive Committee to ensure the Constitution is not violated, and to point out and help preventing any misdoing in the work.
•  To examine the working report and the financial report of the Executive Committee semi-annually.
•  To convey the suggestions, comments and ideas from the members to the Executive Committee.
•  In case of any important matters such as amendment of the Constitution and the construction of the Governing Board of the CSSA, the Supervisory Committee has the right to request for a Joint Meeting of the Executive Committee and the Supervisory Committee, and the members of the Supervisory Committee have the right to involve in the decision-making, and the right of voting.
•  In case that the Executive Committee refuses to take the consideration of the unanimous decision from the Supervisory Committee, with the agreement of the half of the Supervisory Committee members, the President of the Supervisory Committee has the right to request the Executive Committee to call on the General Meeting within 2 weeks to discuss the related issues. The Supervisory Committee has the right to call on the General Meeting if the Executive Committee failed to convene such a General Meeting after the deadline of the 2 weeks.
A Sub-Association of the UBC CSSA can be established in any faculty or department with over 10 Chinese students and scholars.
•  The Governing Board of a Sub-Association is composed of President and 2 Directors who can be elected or recommended by the Chinese students at the faculty and the department. The President and the Directors shall be the UBC CSSA voting members, and shall subject the approval from the UBC CSSA Executive Committee.
•  The Sub-Association can organize their own events and activities independently in accordance with the Constitution of the UBC CSSA and under the leadership of the Executive Committee.
•  The Sub-Association can apply for a sum of grant to subsidize their events from the UBC CSSA, and the Executive Committee will make a decision on the application based on the financial situation and the number of people in the Sub-Association.
Under the approval of the Executive Committee, all members can organize various kinds of sport clubs or teams, and the Executive Committee shall give the necessary support even the financial support if it is possible.
Election


  • The President and the Vice-Presidents of the Executive Committee, and the President of the Supervisory Committee shall be elected with votes by the Voting Members in the democratic way in the General Meeting. The President of the Executive Committee and the President of the Supervisory Committee must be elected in the General Meeting. The terms for the President and the Vice-Presidents of the Executive Committee, and for the President of the Supervisory Committee are all 1 year. The President and the Vice-Presidents of the Executive Committee, and the President of the Supervisory Committee can run for the second consecutive term in the new election, but they are only allowed to run for 1 more year term.
  • In general, the election of the new Executive Committee and the new Supervisory Committee shall be held in late December and shall be completed before the end of each calendar year. The elected members of the two Committees must obtain the vote of approval from over the half of the total Voting Members who attend the General Meeting, in another word, with a simple majority of the votes cast. The in-service Executive Committee and Supervisory Committee shall organize and form an Election Board in 4 weeks prior to the General Meeting, and the Election Board shall be the only authoritative body in charge of the impending election.
  • Member of Election Board shall not be a current CSSA Executive Committee member, nor a candidate for the upcoming election. Members of Election Board lose the right to be elected in the upcoming election seven (7) days after the commencing of Election Board.
  • Election Board shall be dismissed voluntarily after completion of the election of the complete new Executive Committee and the new Supervisory Committee, or after election of the Presidents for the new Executive Committee and the new Supervisory Committee.
  • In case that there is no any candidate running for the position of the President of the Executive Committee and/or for the position of the President of the Supervisory Committee in the General Meeting, or that the positions for the any of 2 Presidents are vacant due to the resignation and/or stepping down, the another/new General Meeting must be held as soon as possible, till the Presidents are elected; However, in case that there is no candidates running for the positions of the Vice-Presidents of the Executive Committee in the General Meeting, or that the positions for the any the Vice-Presidents are vacant due to the resignation and/or stepping down, a Joint Meeting of the Executive Committee and the Supervisory Committee can be held to openly recruit the Vice-Presidents by voting, the elected Vice-Presidents must obtain the vote of approval from over the half of the members of the existing Executive Committee and Supervisory Committee, or in another work, with the simple majority of the vote of the members of the 2 Committees.
  • Within 15 days after the President and all the Vice-Presidents of the Executive Committee, and the President of the Supervisory Committee are elected, a Joint Meeting of the Executive Committee and the Supervisory Committee shall be held to openly recruit the Executive Directors of the Executive Committee and the Supervisory Directors of the Supervisory Committee. The terms for all the Directors are the same as for the the President and all the Vice-Presidents of the Executive Committee, and the President of the Supervisory Committee.
  • In principle, the candidates who failed to be elected to be the President and all the Vice-Presidents of the Executive Committee, and the President of the Supervisory Committee can be automatically accepted to be the Directors on the volunteering basis.
  • The outgoing Executive Committee shall actively assist the incoming Executive Committee to facilitate a smooth transition. The former is also responsible to turn over all properties managed by CSSA to the latter within four weeks of the election.
Funding

The financial resources of the CSSA are:

  • Annual membership fees;
  • Revenue generated from ticket sale in CSSA-organized events;
  • Funds received from Chinese Consulate General in Vancouver ;
  • Donations and sponsors from individuals, businesses and other organizations.
Amendment of Constitution

Any amendment to the existing Constitution must be approved by the over half of the eligible Voting Members present in a General Meeting. An amendment to Constitution is in effect immediately after its approval by over a half of the eligible Voting Members at a General Meeting where the amendment or revision is proposed for ratification.
