So far a number of questions have been commonly asked:
1.What if I have already received a selection decision?
If you have already received a positive decision in your case there is
no need to do anything. The class action settlement does not affect
that decision.
2.What if I did not apply in the skilled worker, self employed,
entrepreneur or investor categories?
If you did not apply in the categories listed in Article 2(a) of the
Settlement Agreement, the notice does not apply to you and you can ignore it.
3.Does the settlement slow down the processing times?
No, the government is processing applications now. The settlement
agreement sets out the maximum times that the government can take to process the applications. Your individual application may be processed much earlier than the maximum.
4.Can you tell me how to make the government process my
application more quickly? Can you tell me whether the government will approve my application?
As class counsel, our role is to answer questions about the terms of the settlement. Unfortunately we cannot assist you with respect to speeding up or with the merits of your individual application. The lawsuit and the settlement deal only with the rules the government should apply to the applications and the maximum time the processing can take. Any questions about your individual application should be directed to the consultant or lawyer who has been handling your case.
5.What happens if the settlement does not go through?
If the settlement does not go through, then the government is under no obligation to process the applications within the time periods set out.
6.What do I do if I am satisfied with the settlement?
If you are satisfied with the settlement you don't have to do anything.If the settlement is approved you will automatically be entitled to the benefits. If you opt out CIC will be under no obligation to process your file within the time period promised, and you may receive a selection decision only after the time periods promised in the Settlement Agreement |
