终于找到官方说法了- 关于枫叶卡有效但未住满两年

本来是为了查没有枫叶卡用移民纸能否入境的, 没想到顺便看到了CIC的解释, 关于不能满足居住要求的永久居民是否能持有效枫叶卡入境.

第11.4节讲的是检查要求入境的永久居民时如何确定其PR状态, 其中说到 (注意红字部分):

When a permanent resident appears at a POE for examination, the BSO must determine whether
the person is a permanent resident.
BSOs must remain cognizant of the fact that the Act gives permanent residents of Canada the right to enter Canada at a POE once it is established that a person is a permanent resident, regardless of non-compliance with the residency obligation in A28 or the presence of other inadmissibilities.

BSOs can refuse entry to a permanent resident only when the person has already lost the status in accordance with the provisions of A46 (such as a final determination has been made that they have failed to comply with the residency obligations or when a removal order comes into effect). In other words, once a permanent resident’s status is established, the person may enter Canada by right and the immigration examination under IRPA concludes.

大概意思就是移民法给与永久居民进入加拿大的权利, 不管他/她是否满足居住要求. 只要该永久居民的PR状态还没有根据移民法第46条被取消, 他/她就有权利进入加拿大.

以前经常看到有人在论坛里问枫叶卡还有效但已不能在五年里住满两年了是否还能进入加拿大, 根据这个指南, 你是完全有权利进入加拿大的. 不过, 这一节里后面又说到如果移民官有证据/理由认定你已经不能满足居住要求了, 他会让你入境, 但可能同时会向上报告你的case, 随后有可能会有进一步的调查, 甚至发removal order给你.

有意思的是, 这个文档里还讲了移民官的检查时应当问什么问题, 以及通过这些问题要了解什么信息. 有兴趣的同学可以看看, 入境时就心中有数了. 除了对永久居民的入境检查, 文档里还讲了如何检查公民(第9章), 新移民(第12章), 以及临时访问的外国人(第13章). 大家可以自行对号入座.

关键的我都翻译了, 简单说就是只要你的PR资格还没有被正式取消(收到removal order之类的), 你就放心大胆地进. 还有啥问题吗?

46条说的是取消PR资格的情况,

(1) A person loses permanent resident status
(a) when they become a Canadian citizen;

(b)on a final determination of a decision made outside of Canada that theyhave failed to comply with the residency obligation under section 28;

(c) when a removal order made against them comes into force; or

(d)on a final determination under section 109 to vacate a decision toallow their claim for refugee protection or a final determination undersubsection 114(3) to vacate a decision to allow their application forprotection.


(2) A person who ceases to be a citizen under paragraph 10(1)(a) of the Citizenship Act, other than in the circumstances set out in subsection 10(2) of that Act, becomes a permanent resident.

签证不代表PR身份, 只有登陆时经移民官确认你们符合条件后, 才会给你PR身份, PR身份是没有年限的. 枫叶卡只是PR身份的一个证明, 有效期五年, 到期再续, 但你的身份并没有期限, 只要你满足做PR的要求.

以此类推, 如果PR身份没被正式取消就还算有效, 那么在枫叶卡快到期前进入加拿大并呆够三年应该够资格入籍了. 不知道有没有人以身试法, 呵呵.
